PLEASE ABIDE BY THE CHECKOUT TIME AS AGREED TO IN THIS CONTRACT TO AVOID ANY FURTHER CHARGES TO YOU. CANCELLATION POLICY ANY CHANGES MADE TO BOOKING AFTER A CONFIRMATION HAS BEEN SENT WILL BE ASSESSED A $100 SERVICE FEE. ACCEPTANCE OF ANY CHANGE IS SUBJECT TO APPROVAL BY MOANA LANUI MANAGEMENT AND HOMEOWNER. GUEST UNDERSTANDS THAT THE OWNER OF THIS PROPERTY RETAINS THE RIGHT TO SELL THEIR PROPERTY AT ANYTIME. IN THE EVENT THE VACATION ACCOMODATION IS SOLD BY THE OWNER, MOANA LANUI WILL ATTEMPT TO TRANSFER THIS CONTRACT TO NEW OWNER(S) OR REFUND %110 OF THE VALUE AGREED UPON. GUEST ACKNOWLEDGES THAT THE PROPERTY OWNER AND OR PROPERTY MANAGER RETAIN THE RIGHT TO ENTER THE PROPERTY FOR ANY REASON, INCLUDING SHOWING PROSPECTIVE BUYER OF THE PROPERTY, BY GIVING GUEST 24 HOUR NOTICE OF SUCH SHOWING. GUESTS WAVE ALL RIGHTS HE OR SHE MAY HAVE UNDER THE RESIDENTIAL LANDLORD/TENANT CODE OF HAWAII REVISED STATUTES CHAPTER 521 SINCE THIS IS A SHORT TERM TRANSIENT VACATION RESERVATION. THIS RENTAL AGREEMENT IS BEING ENTERED INTO AND SHALL BE PERFORMED IN THE STATE OF HAWAII AND IS GOVERNED AND CONSTRUED IN ALL RESPECTS IN ACCORDANCE WITH THE LAWS OF THE STATE OF HAWAII, REGARDLESS OF THE STATE _____ PLACE OF DOMICILE OR RESIDENCE OF EITHER PARTY. THIS AGREEMENT SUPERSEDES ALL PRIOR ORAL DISCUSSIONS, WRITTEN INFORMATION, E-MAILS, OR FAXES DEEMED AS ORIGINALS. IF THE PARTIES CANNOT RESOLVE ANY CONTROVERSY AS DESCRIBED INTERPRETATION, MODIFICATION, OR ALLEGED BREACH OF CONTRACT THROUGH NEGOTIATION, THE PARTIES AGREE FIRST TO TRY IN GOOD FAITH TO TRY AND SETTLE THE DISPUTE BY MEDIATION IN HONOLULU, HI ADMINISTERED BY THE AMERICAN ARBITRATION ASSOSIATION UNDER ITS COMMERCIAL MEDIATION RULES BEFORE RESORTING TO ARBITRATION OR SOME OTHER DISPUTE RESOLUTION PROCEDURE. IN THE EVENT THAT MEDIATION FAILS, THE PARTIES AGREE ANY CONTROVERSY OR CLAIM ARISING FROM OR RELATED TO THIS CONTRACT OR THE BEACH THEREOF SHALL BE SETTLED BY ARBRITRATION IN HONOLULU, HI ADMINISTERED BY THE AMERICAN ABITRATION ASSOSIATION IN ACCORDANCE WITH THE ARBITRATION RULES OF THE AMERICAN ARBITRATION ASSOSIATION THEN IN EFFECT. NOTICE OF DEMAND FOR ARBITRATION SHALL BE FILLED IN WRITING WITH THE OTHER PARTY TO THIS CONTRACT AND WITH THE AMERICAN ARBITRATION ASSOSIATION AND SHALL BE MADE WITHIN A REASONABLE TIME AFTER THE DISPUTE HAS ARISEN. THE AWARD RENDERED BY THE ARBITRATOR (S) SHALL BE FINAL AND JUDGEMENT MAY BE ENTERED UPON IT IN ACCORDANCE WITH APPLICABLE LAW IN ANY COURT HAVING JURISDICTION. THE PROVISIONS OF THIS PARAGRAPH SHALL BE SPECIFICALLY ENFORCABLE UNDER APPLICABLE LAW IN ANY COURT HAVING JURISDICTION. EACH PARTY SHALL BE RESPONSIBLE FOR THE PAYMENT OF ITS OWN ATTORNEY’S FEES AND DISBURSEMENT. ADDITIONAL TERMS AND CONDITIONS FOR THIS PROPERTY CONDITIONS OF RENTAL THIS RESERVATION IS ACCEPTED FOR ONE FAMILY OR GROUP OF INDIVIDUALS FOR THIS ACCOMIDATION ONLY. UNLESS DISCLOSED TO AND AGREED UPON BY MOANA LANUI, THIS RENTAL WILL NOT BE USED IN COMBINATION WITH OTHER ACCOMIDATIONS. THIS RESERVATION IS FOR A QUIET RESIDENTIAL VACATION ACCOMIDATION ONLY. THEREFORE, PARTIES, RECEPTIONS, LUAUS, EVENTS, AND GATHERINGS OF ANY KIND ARE STRICTLY PROHIBITED. NO ADDITIONAL PEOPLE BEYOND THE MAX. OCCUPANCY OF THE HOUSE ARE ALLOWED ON THE PROPERTY AT ANY ONE TIME, UNLESS DISCLOSED TO AND AGREED UPON BY MOANA LANUI IN WRITING. ONLY 2 VEHICLES MAY BE PARKED ON THIS PROPERTY AT ONE TIME. QUIET HOURS ARE FROM 8PM TO 8AM. GUEST USE OF PROPERTY IS SUBJECT TO LOCAL NOISE ORDINANCES. THEREFORE LOUD AMPLIFIED MUSIC IS STRICTLY PROHIBITED. NOISE COMPLAINTS ARE SUBJECT TO LOCAL LAW ENFORCEMENT INTERVENTION. LAW ENFORCEMENT INTERVENTION WILL BE SEEN BY MOANA LANUI MANAGEMENT AS A VIOLATION OF THIS CONDITION. THE PROPERTY SHALL BE IN THE SAME CONDITION UPON DEPARTURE AS AT THE TIME OF CHECK-IN. NORMAL WEAR AND TEAR ACCEPTED. GUEST MAY NOT SUBLET OR ASSIGN THIS RENTAL AGREEMENT. GUEST MAY COOK ONLY IN AREAS DESIGNATED FOR COOKING. GUEST MUST IMMEDIATELY NOTIFY MOANA LANUI MANAGEMENT OF FIRE OR OTHER DAMAGE TO THE PROPERTY. GUEST SHALL BE LIABLE FOR ALL ACTS OF THE FAMILY, INVITEES, EMPLOYEES, OR OTHER PERSONS INVITED ONTO THE PROPERTY. GUEST SHALL BE RESPONSIBLE TO RETURN ALL KEYS UPON DEPARTURE. GUEST SHALL ABIDE BY THE HOUSE RULES OF THE OWNER AS PROVIDED TO GUEST AT CHECK-IN. GUEST SHALL NOT BRING ANY PETS ONTO THE PROPERTY. UNDER NO CIRCUMSTANCES, NO SMOKING ALLOWED INSIDE THE HOUSE: RESULTS MAY EFFECT DEPOSIT TO COVER SMOKE REMOVAL COSTS. GUEST UNDERSTANDS THAT HAWAII IS A TROPICAL CLIMATE IN WHICH INSECTS, RODENTS, AND LIZARDS UNFORTUNATELY FLOURISH. YOU WILL UNDOUBTEDLY ENCOUNTER THESE PESTS DURING YOUR STAY AND UNDERSTAND THAT MOANA LANUI MANAGEMENT AND OWNERS WILL MAKE OUR BEST EFFORT TO HOLD TO AN ABSOLUTE MINIMUM YOUR INTERACTION WITH THESE PESTS. CONTACT WITH A PEST INSIDE OR OUTSIDE OF YOUR RENTAL IS NOT REASON FOR TERMINATION OF THIS AGREEMENT NOR A REFUND OF YOUR MONIES. GUEST UNDERSTANDS THAT THERE ARE CERTAIN RISKS INHERENT TO PERSONS AND PROPERTY LOCATED ADJACENT TO THE OCEAN. GUEST AND OTHER INVITEES SHALL MAKE USE OF THE OCEAN AND ITS INHABITANTS AT THEIR OWN RISK. GUESTS ACKNOWLEDGE THAT OWNER WOULD NOT RENT THIS PROPERTY UNLESS THE GUESTS ACCEPTED THESE TERMS. PLEASE NOTE AS A REMEDY FOR VIOLATION OF ANY OF THE STATED CONDITIONS OF RENTAL IN THIS AGREEMENT, MOANA LANUI HAS THE RIGHT, BUT NOT LIMITED TO, TERMINATE THIS AGREEMENT AND EVICT THE TENANT WITHOUT REFUND OF COLLECTED MONEY AND KEEP ALL PORTION OF THE SECURITY DEPOSIT. ADDITIONAL DISCLOSURES UNDER NO CIRCUMSTANCES SHALL MOANA LANUI MANAGEMENT OR OWNERS BE RESPONSIBLE FOR ANY EXPENSE, DAMAGES, CLAIM OF INJURY DIRECT, OR INDIRECT, CONSEQUENTIAL OR OTHERWISE WHATSOEVER, CAUSED OR INCURRED WHETHER ARISING IN CONTRACT, OR OTHERWISE IN LAW OR EQUITY AS A RESULT OF RENDERING OF THE SERVICE ACCOMODATIONS AS DESCRIBED IN THIS AGREEMENT OR AS A RESULT OF ANY DELAY (S), SUBSTITUTION (S), RESCHEDULING, OR CHANGES IN THE SERVICE OR ACCOMODATIONS MADE BY MOANA LANUI MANGEMENT. ADDITIONALLY, MOANA LANUI MANAGEMENT AND OWNERS, SHALL NO WAY BE RESPONSIBLE FOR ANY LOSS, EXPENSE, DAMAGES, CLAIMS OF INJURY DIRECT, OR INDIRECT, CONSEQUENCIAL OR OTHERWISE CAUSED BY REASON OF MILITARY ACTIONS, ACTS OF GOD, OR BY ANY AGENTS, EMPLOYEES, SUBCONTRACTORS, SERVANTS, SERVICES AS PROVIDED OR SUBSTITUTED. MOANA LANUI MANGEMENT AT ALL TIMES WILL ACT IN GOOD FAITH AND USE ITS BEST EFFORTS TO SUBSTITUTE WITH ACCOMIDATIONS OR SERVICES OF A TYPE COMPARABLE TO THOSE CONTRACTED. MOANA LANUI MANAGEMENT IN THEIR SOLE AND UNFETTERED DISCRETION RESERVES THE RIGHT TO REFUSE OR DISCONTINUE SERVICE TO PERSON (S) AND OR RESCIND ANY CONTRACT FOR ACCOMODATIONS OR GUEST SERVICES. MOANA LANUI MANAGEMENT OR OWNERS ARE NOT LIABLE UNDERANY CIRCUMSTANCES, INCLUDING SUBSTITUTIONS, TO REFUND ANY UNUSED PORTION OF BOOKED ACCOMODATIONS AND SERVICES. MOANA LANUI MANGEMENT AND ITS OWNERS ARE NOT RESPONSIBLE FOR THEFT OR DAMAGE OF PERSONAL PROPERTY AND NO REFUNDS WILL BE GIVEN FOR ANY SUCH OCCURANCES. GUEST AND ALL OCCUPANTS HAVE BEEN ADVISED NOT TO LEAVE PERSONAL ARTICLES IN LOCKED VEHICLES; EVEN IF IN THE TRUNK; TO ALWAYS LOCK THEIR VEHICLE; TO ALWAYS SECURE THE DWELLING. IF RENTING MOPEDS, BICYCLES OR ANY OTHER VEHICLES IT IS STRONGLY SUGGESTED TO ARRANGE FOR ADDITIONAL INSURANCE, WHICH PROVIDE ADEQUATE PROTECTION IN THE EVENT OF DAMGE OR THEFT. IN ORDER TO PROCESS A RESERVATION, ALL MONIES ARE PAID IMMEDIATELY TO LEGAL OWNERS TO SECURE RESERVATION. |
